Estate Planning and Probate Administration
Boutin Lowman offers its clients cost-effective, practical estate plans that meet the needs of individuals and families. Our attorneys have experience preparing wills, trusts, powers of attorney for financial affairs, and durable powers of attorney for health care that include advance directives. Our firm is experienced in the use of joint tenancies, trusts, life insurance, and other instruments to protect assets and pass them directly to the heirs. Because estate planning also includes planning for end of life, we address HIPPA authorization and nomination of a guardian should one ever be required.
Boutin Lowman counsels probate administrators and executors, efficiently managing probate of the estate through the court’s electronic filing system, negotiating with creditors to settle any claims, distribution of assets, and management of probate where there is no will. We are pleased to provide ancillary probate administration services for executors who live outside New Hampshire, without the need to return to the state.
While our goal is always to wrap up probate of an estate as expeditiously as possible, in the event of a dispute or other challenge to a will or trust, Boutin Lowman offers services as negotiators and mediators, or if necessary, as litigators to achieve practical, equitable resolution of differences. We have experience litigating claims for undue influence and lack of testamentary capacity, as well as claims for breaches of fiduciary duties, fraudulent transfers, and financial exploitation of dependent or elderly individuals.
